Once Manipur gets an ...\" \/><\/p>\n<ul>\n<li><strong>Assam Accord:<\/strong>\n<ul>\n<li>It was a\u00a0<strong>tripartite accord<\/strong>\u00a0signed between the\u00a0<strong>Government of India, State Government of Assam and the leaders of the Assam Movement<\/strong>\u00a0in 1985.<\/li>\n<li>The signing of the Accord\u00a0<strong>led to the conclusion of a six-year agitation<\/strong>\u00a0that was launched by the All Assam Students\u2019 Union (AASU) in 1979,\u00a0<strong>demanding the identification and deportation of illegal immigrants<\/strong>\u00a0from Assam.<\/li>\n<li>It sets a\u00a0<strong>cut-off<\/strong>\u00a0of midnight of\u00a0<strong>24<sup>th<\/sup>\u00a0March 1971,<\/strong>\u00a0for the detection of\u00a0<strong>illegal foreigners in Assam.<\/strong><\/li>\n<li>However, the\u00a0<strong>demand<\/strong>\u00a0was for detection and deportation of migrants who had illegally entered Assam after\u00a0<strong>1951.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #ff0000;\"><strong>Clause 6 of the Accord:<\/strong><\/span>\n<ul>\n<li>It says that\u00a0<strong>constitutional, legislative and administrative safeguards,<\/strong>\u00a0as may be appropriate, shall be provided to protect, preserve and promote the cultural, social, linguistic identity and heritage of the\u00a0<strong>Assamese people.<\/strong><\/li>\n<li>The committee chaired by<strong>\u00a0Biplab Kumar Sarma<\/strong>\u00a0was constituted<strong>\u00a0to define \u2018Assamese People\u2019<\/strong>\u00a0and institute safeguards for them.<\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #ff0000;\"><strong>Recommendation of the Committee:<\/strong><\/span>\n<ul>\n<li><strong>Definition of Assamese:<\/strong>\u00a0The report<strong>\u00a0proposes January 1951 as the cut-off date<\/strong>\u00a0for any Indian citizen residing in Assam<strong>\u00a0to be defined as an Assamese<\/strong>\u00a0for the purpose of implementing Clause 6.<\/li>\n<li><strong>Reservation for Assamese:<\/strong>\u00a0The report seeks reservation for Assamese in Parliament, state assembly, local bodies. It recommended creating an Upper House (Legislative Council of Assam) whose seats will be reserved for the \u2018Assamese people\u2019.\n<ul>\n<li>The report also seeks\u00a0<strong>quotas in government jobs.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Regulation of Outsiders:<\/strong>\u00a0The report recommends regulation of entry of people from other states into Assam, which include the implementation of an<strong>\u00a0Inner Line Permit (ILP)<\/strong>\u00a0regime in the state.<\/li>\n<li><img decoding=\"async\" src=\"https:\/\/aspirantmedia.files.wordpress.com\/2018\/09\/1286px-assam_19501171517815.png?w=584&amp;h=544\" alt=\"INNER LINE REGULATIONS | ASPIRANTS\" \/>\n<ul>\n<li>The ILP is a system in which a special permit is required by people from other regions of India to visit the state.<\/li>\n<li>Currently the ILP is applicable in\u00a0<strong>Manipur, Arunachal Pradesh, Nagaland and Mizoram.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Other Rights:<\/strong>\u00a0The report also talks about issues related to land and land rights, linguistic, cultural and social rights and protection of the state\u2019s resources and biodiversity.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Issues Involved:<\/strong>\n<ul>\n<li>According to the recommendations, people who migrated between 1951 and 1971, including large sections of post-Partition refugees,\u00a0<strong>would be Indian citizens under the Assam Accord<\/strong>\u00a0and the\u00a0<strong>National Register of Citizens (NRC)<\/strong>, but they\u00a0<strong>would not be eligible for safeguards meant for \u201cAssamese people\u201d<\/strong>\u00a0under Clause 6 of the Accord.<\/li>\n<li><strong>East Bengal migrants<\/strong>\u00a0who entered Assam before 1951 would be<strong>\u00a0considered Assamese.<\/strong><\/li>\n<li>There is\u00a0<strong>no mechanism<\/strong> to prove that a person has been in Assam prior to 1951.<\/li>\n<li>The 1951\u00a0<strong>NRC is not available in several parts<\/strong>\u00a0of the state and the\u00a0<strong>current NRC being made uses 1971 as a cut-off.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><span style=\"color: #ff0000;\">Way Forward<\/span><\/h3>\n<ul>\n<li>The key legal and constitutional issue that needs to be considered is whether the definition of an Assamese or a Bengali or a Punjabi or a Tamil define her\/his Indian-ness or an Indian citizenship.<\/li>\n<li>The definition of Assamese is connected to the NRC process as the Assam Accord cannot be reviewed in isolation of one clause or the other.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #0000ff;\"><strong>For more such notes, Articles, News &amp;
