To ensure the conduct of elections in free, fair and in an impartial manner, the constitution-makers incorporated\u00a0<strong>Part XV (Articles.324-329)<\/strong>\u00a0in the constitution and empowered Parliament to make laws to regulate the electoral process.<strong>The<\/strong>\u00a0<strong>Election Commission of India (ECI)<\/strong>\u00a0is the watchdog of<strong>\u00a0free<\/strong>\u00a0and\u00a0<strong>fair elections<\/strong>\u00a0in the country and\u00a0<strong>Article 324<\/strong>\u00a0of the Constitution provides for its establishment. In this context, the Parliament has enacted the Representation of the People Act\u00a0<strong>(RPA)<\/strong>, 1950 and Representation of the People Act,1951. In this TTP, we will cover RPA, 1950 followed by the TTP on RPA, 1951 and other aspects related to both the acts.<\/li>\n<\/ul>\n<h3>\u00a0 \u00a0 \u00a0 \u00a0\u00a0<img decoding=\"async\" src=\"https:\/\/www.iastoppers.com\/wp-content\/uploads\/2020\/02\/The-Representation-of-the-People-Act-1951.jpg\" alt=\"The-Representation-of-the-People-Act-1951 | IASToppers\" \/><\/h3>\n<h3>Background<\/h3>\n<ul>\n<li><strong>Universal suffrage:<\/strong>\u00a0After independence, there was a need to hold\u00a0<strong>general elections<\/strong>\u00a0to elect a truly representative government on the basis of<strong>\u00a0universal adult suffrage.<\/strong><\/li>\n<li><strong>Article 325<\/strong>\u00a0of the constitution ensures\u00a0<strong>universal suffrage<\/strong>\u00a0and provides that no person be ineligible for inclusion in, or to claim to be included in a special, electoral roll on grounds of religion, race, caste or sex.<\/li>\n<\/ul>\n<div class=\"border-bg\">\n<p><strong>Universal Adult Suffrage<\/strong><\/p>\n<p>Universal adult suffrage is the right to vote of all adult citizens, regardless of wealth, income, gender, social status, race, or ethnicity, subject only to minor exceptions.<\/p>\n<\/div>\n<ul>\n<li><strong>Election Commission of India (ECI):<\/strong>\u00a0The ECI as an<strong>\u00a0independent constitutional authority<\/strong>\u00a0was therefore brought into force from\u00a0<strong>November 26<sup>th<\/sup>, 1949.<\/strong><\/li>\n<li><strong>The Acts:<\/strong>\u00a0To provide a\u00a0<strong>legal framework<\/strong>\u00a0for the conduct of elections, Parliament passed the\u00a0<strong>Representation of the People Act, 1950, Representation of the People Act, 1951<\/strong>\u00a0and\u00a0<strong>Delimitation Commission Act of 2002.<\/strong><\/li>\n<li><strong>Delimitation:<\/strong>\u00a0For the purpose of<strong>\u00a0first general elections<\/strong>\u00a0to the Lok Sabha and Vidhan Sabhas, the\u00a0<strong>first delimitation order<\/strong>\u00a0was issued by the President,<strong>\u00a0in consultation with ECI<\/strong>\u00a0and with the approval of Parliament in August 1951.<\/li>\n<\/ul>\n<h3>Representation of the People Act (RPA), 1950<\/h3>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><strong>Key Provisions<\/strong>\n<ul>\n<li>Lays down procedures for\u00a0<strong>delimitation of constituencies.<\/strong><\/li>\n<li>Provides for the<strong>\u00a0allocation of seats<\/strong>\u00a0in the House of the People and in the Legislative Assemblies and Legislative Councils of States.<\/li>\n<li>Lays procedure for the\u00a0<strong>preparation of electoral rolls<\/strong>\u00a0and the manner of filling seats.<\/li>\n<li>Lays down the\u00a0<strong>qualification of voters.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>Delimiting Constituencies<\/strong>\n<ul>\n<li>The\u00a0<strong>President<\/strong>\u00a0of India has been conferred the power to<strong>\u00a0amend<\/strong>\u00a0orders delimiting constituencies,\u00a0<strong>only after consulting the ECI.<\/strong><\/li>\n<li>In Lok Sabha, there is a reservation of seats for\u00a0<strong>Scheduled Castes and Scheduled Tribes.<\/strong><\/li>\n<li>The ECI has the power to determine the constituencies to be reserved for scheduled tribes in the states of Meghalaya, Mizoram, Nagaland and Tripura.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<div class=\"border-bg\">\n<p><strong>Delimitation Commission<\/strong><\/p>\n<ul>\n<li>Under\u00a0<strong>Article 82<\/strong>\u00a0of the Constitution, the Parliament by law enacts a\u00a0<strong>Delimitation Act after every census.<\/strong><\/li>\n<li>After coming into force the commencement of the Act, the Central Government constitutes a\u00a0<strong>Delimitation Commission.<\/strong><\/li>\n<li>This Delimitation Commission demarcates the boundaries of the Parliamentary Constituencies as per provisions of the Delimitation Act.<\/li>\n<li>The<strong>\u00a0present delimitation<\/strong>\u00a0of constituencies has been done on the basis of the\u00a0<strong>2001 census<\/strong>\u00a0figures under the provisions of\u00a0<strong>Delimitation Act, 2002.<\/strong><\/li>\n<li>Notwithstanding the above, the Constitution of India was specifically amended in 2002\u00a0<strong>not to have delimitation of constituencies till the first census after 2026.<\/strong>\u00a0Thus, the present Constituencies carved out on the basis of the 2001 census shall continue to be in operation till the first census after 2026.<\/li>\n<\/ul>\n<\/div>\n<ul>\n<li><strong>Allocation of seats:<\/strong>\u00a0As far as possible, every state gets representation in the<strong>\u00a0Lok Sabha<\/strong>\u00a0in\u00a0<strong>proportion to its population<\/strong>\u00a0as per census figures.<\/li>\n<li><strong>Electoral Rolls<\/strong><\/li>\n<li>The 1950 Act permits the registration of persons in electoral rolls who are\u00a0<strong>ordinarily resident<\/strong>\u00a0in a constituency and persons<strong>\u00a0holding:<\/strong>\n<ul>\n<li><strong>Service<\/strong>\u00a0qualification such as a member of\u00a0<strong>armed forces, member of the armed police force of a state,<\/strong>\u00a0serving outside the state, or central government employees posted outside India.<\/li>\n<li><strong>Certain offices in India<\/strong>\u00a0declared by the President in consultation with ECI.<\/li>\n<li>The wives of such persons are also deemed to be ordinarily residing in India. There is a proposal for making some provisions\u00a0<strong>gender-neutral<\/strong>\u00a0by replacing the term \u2018wife\u2019 with \u2018spouse\u2019.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Chief Electoral Officer (CEO)<\/strong>\n<ul>\n<li>Each state to have a CEO nominated or designated by the ECI in\u00a0<strong>consultation with the state government\u00a0<\/strong>to<strong>\u00a0supervise<\/strong>\u00a0the election work in the State\/ UTs.<\/li>\n<li>The ECI also nominates or designates an officer of the state as the\u00a0<strong>District Election Officer (DEO)<\/strong>\u00a0in consultation with the state government\n<ul>\n<li>The DEO works under the overall superintendence and control of the CEO.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Electoral Registration Officer (ERO)<\/strong>\n<ul>\n<li>The ERO is responsible for the<strong>\u00a0preparation of the electoral roll<\/strong>\u00a0for each constituency (parliamentary\/assembly).<\/li>\n<li>An appeal against the order of the ERO during the update of the electoral rolls now lies with<strong>\u00a0District Magistrate.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Returning Officer(RO)<\/strong>\n<ul>\n<li>RO is responsible for the conduct of the election in\u00a0<strong>a constituency<\/strong>\u00a0and\u00a0<strong>returns an elected candidate.<\/strong><\/li>\n<li>The ECI nominates or designates an officer of the government or local authority as the RO in\u00a0<strong>consultation with the state government.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Power to make rules<\/strong>\u00a0under the act is conferred to the Central\u00a0<strong>government,<\/strong>\u00a0which can exercise this power in\u00a0<strong>consultation with the ECI.<\/strong>\n<ul>\n<li>The\u00a0<strong>Civil Courts<\/strong>\u00a0have also been\u00a0<strong>barred<\/strong>\u00a0to question the legality of any action of the<strong>\u00a0ERO<\/strong>\u00a0regarding\u00a0<strong>revision of electoral rolls.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Voting Rights:<\/strong>\u00a0In 2010, voting rights were extended to citizens of India living abroad.<\/li>\n<\/ul>\n<div class=\"border-bg\">\n<p><strong>RPA, 1950 Schedules<\/strong><\/p>\n<ul>\n<li><strong>The First Schedule:<\/strong>\u00a0Allocation of seats in the House of the People<\/li>\n<li><strong>The Second Schedule:<\/strong>\u00a0Total number of seats in the Legislative Assemblies<\/li>\n<li><strong>The Third Schedule:<\/strong>\u00a0Allocation of seats in the Legislative Councils<\/li>\n<li><strong>The Fourth Schedule:<\/strong>\u00a0Local authorities for purposes of elections to Legislative Councils<\/li>\n<\/ul>\n<\/div>\n<p><img decoding=\"async\" src=\"https:\/\/image.slidesharecdn.com\/legalaspectsofad-coltambekar-111003070714-phpapp02\/95\/legal-aspects-of-ad-col-tambekar-58-728.jpg?cb=1317625760\" alt=\"Legal aspects of ad col tambekar\" \/><\/p>\n<p><span style=\"color: #0000ff;\"><strong>For more such notes, Articles, News &amp;
