{"id":9166,"date":"2020-07-24T17:31:08","date_gmt":"2020-07-24T12:01:08","guid":{"rendered":"https:\/\/triumphias.com\/blog\/?p=9166"},"modified":"2020-07-24T17:31:08","modified_gmt":"2020-07-24T12:01:08","slug":"consumer-protection-act-2019","status":"publish","type":"post","link":"https:\/\/triumphias.com\/blog\/consumer-protection-act-2019\/","title":{"rendered":"Consumer Protection Act, 2019"},"content":{"rendered":"<div class=\"post-inner thin \">\n<div class=\"entry-content\">\n<h4 class=\"s3\">Relevance: Prelims: Polity<\/h4>\n<p><img decoding=\"async\" src=\"https:\/\/www.insightsonindia.com\/wp-content\/uploads\/2020\/07\/act1986_act2019.jpg\" alt=\"Consumer Protection Act 2019 - INSIGHTSIAS\" \/><\/p>\n<p>&nbsp;<\/p>\n<h4 class=\"s3\"><span class=\"s2\">Definition of consumer<\/span><\/h4>\n<ul>\n<li class=\"s6\"><span class=\"s2\">A consumer is defined as a person who buys any good or avails a service for a consideration.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">It does not include a person who obtains a good for resale or a good or service for commercial purpose.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">It covers transactions through all modes including offline, and online through electronic means, teleshopping, multi-level marketing or direct selling.<\/span><\/li>\n<\/ul>\n<h4 class=\"s3\"><span class=\"s2\">Rights of consumers<\/span><\/h4>\n<p class=\"s3\"><span class=\"s2\">The following<\/span><span class=\"s2\">\u00a0consumer rights have been defined in the Act, including the right to:<\/span><\/p>\n<ul>\n<li class=\"s6\"><span class=\"s2\">be protected against marketing of goods and services which are hazardous to life and property;<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">be informed of the quality, quantity, potency, purity, standard and price of goods or services;<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">be assured of access to a variety of goods or services at competitive prices; and<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">seek redressal against unfair or restrictive trade practices.<\/span><span class=\"s2\"><br \/>\n<\/span><span class=\"s2\">\u00a0<\/span><\/li>\n<\/ul>\n<h4><img decoding=\"async\" src=\"https:\/\/image.slidesharecdn.com\/2019cpa-191025041817\/95\/consumer-protection-act-2019-2-638.jpg?cb=1571977153\" alt=\"Consumer Protection Act 2019\" \/><\/h4>\n<h4 class=\"s3\"><span style=\"color: #ff0000;\"><span class=\"s2\">Establishment of\u00a0<\/span><span class=\"s2\">Central Consumer Protection Authority<\/span><\/span><\/h4>\n<ul>\n<li class=\"s6\"><span class=\"s2\">The central government will set up a\u00a0<\/span><span class=\"s2\">CCPA<\/span><span class=\"s2\">\u00a0to promote, protect and enforce the rights of consumers.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">It will regulate matters related to violation of consumer rights, unfair trade practices, and misleading advertisements.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">The CCPA will have an investigation wing, headed by a Director-General, which may conduct inquiry or investigation into such violations.\u00a0<\/span><\/li>\n<\/ul>\n<h4 class=\"s3\"><span class=\"s2\" style=\"color: #ff0000;\">Penalties for misleading advertisement<\/span><\/h4>\n<ul>\n<li class=\"s6\"><span class=\"s2\">The CCPA may impose a penalty on a manufacturer or an endorser of up to Rs 10 lakh and imprisonment for up to two years for a false or misleading advertisement.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">In case of a subsequent offence, the fine may extend to Rs 50 lakh and imprisonment of up to five years.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">CCPA can also prohibit the endorser of a misleading advertisement from endorsing that particular product or service for a period of up to one year.<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">For every subsequent offence, the period of prohibition may extend to\u00a0<\/span><span class=\"s2\">three years.\u00a0<\/span><span class=\"s2\">\u00a0<\/span><\/li>\n<\/ul>\n<h4 class=\"s3\"><span class=\"s2\" style=\"color: #ff0000;\">Consumer Disputes Redressal Commission<\/span><\/h4>\n<ul>\n<li class=\"s6\"><span class=\"s2\">CDRCs<\/span><span class=\"s2\">\u00a0will be set up at the district, state, and national levels.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">A consumer can file a complaint with CDRCs in relation to: unfair or restrictive trade practices;\u00a0<\/span><span class=\"s2\">defective goods or services<\/span>\u00a0<span class=\"s2\">etc.<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">Complaints against an unfair contract can be filed with only the State and National \u00a0 Appeals from a District CDRC will be heard by the State CDRC.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">Appeals from the State CDRC will be heard by the National CDRC.\u00a0 Final appeal will lie before the Supreme Court.<\/span><\/li>\n<\/ul>\n<h4 class=\"s3\"><span class=\"s2\" style=\"color: #ff0000;\">Jurisdiction of CDRCs<\/span><\/h4>\n<ul>\n<li><span class=\"s2\">The District CDRC will entertain complaints where value of goods and services does not exceed Rs one crore.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">The State CDRC will entertain complaints when the value is more than Rs one crore but does not exceed Rs 10 crore.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">Complaints with value of goods and services over Rs 10 crore will be entertained by the National CDRC.<\/span><span class=\"s2\"><br \/>\n<\/span><span class=\"s2\">\u00a0<\/span><\/li>\n<\/ul>\n<h4 class=\"s3\"><span class=\"s2\" style=\"color: #ff0000;\">Product liability<\/span><\/h4>\n<ul>\n<li class=\"s6\"><span class=\"s2\">Product liability means the liability of a product manufacturer, service provider or seller to compensate a consumer for any harm or injury caused by a defective good or deficient service.\u00a0<\/span><\/li>\n<li class=\"s6\"><span class=\"s2\">To claim compensation, a consumer has to prove any one of the conditions for defect or deficiency, as given in the Act.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #0000ff;\"><strong>For more such notes, Articles, News &amp;
