{"id":8713,"date":"2020-06-22T14:32:05","date_gmt":"2020-06-22T09:02:05","guid":{"rendered":"https:\/\/triumphias.com\/blog\/?p=8713"},"modified":"2023-04-07T17:24:42","modified_gmt":"2023-04-07T11:54:42","slug":"sec-309-of-indian-penal-code-ipc","status":"publish","type":"post","link":"https:\/\/triumphias.com\/blog\/sec-309-of-indian-penal-code-ipc\/","title":{"rendered":"Sec 309 of Indian Penal Code (IPC)"},"content":{"rendered":"<section class=\"hero-section\" data-type=\"type-1\">\n<h1>Sec 309 of Indian Penal Code (IPC)<\/h1>\n<header class=\"entry-header\"><span style=\"color: #0000ff;\"><strong>Relevance: Prelims: Polity: Governance<\/strong><\/span><\/header>\n<header><\/header>\n<header class=\"entry-header\"><strong>Why in news?<\/strong><\/header>\n<\/section>\n<div class=\"entry-content\">\n<p>\u2022 One of the most archaic laws that punishes attempts to commit suicide \u2013 Section 309 of the Indian Penal Code (IPC)\u2014 continues to exist in the statute book and is often misused.<\/p>\n<p><b>About:<\/b><\/p>\n<\/div>\n<p><img decoding=\"async\" src=\"https:\/\/image.slidesharecdn.com\/decriminalizationofsection309indianpenalcode-160416054822\/95\/decriminalization-of-section-309-indian-penal-code-7-638.jpg?cb=1460785756\" alt=\"Decriminalization of section 309 indian penal code,\" \/><\/p>\n<p>&nbsp;<\/p>\n<div class=\"entry-content\">\n<p>\u2022 <span style=\"text-decoration: underline; color: #ff0000;\"><strong>Anyone who survives an attempted suicide can be booked under Section 309 IPC, which deals with \u201cAttempt to commit suicide\u201d.<\/strong><\/span><\/p>\n<p>\u2022<strong> The section reads:<\/strong> \u201cWhoever attempts to commit suicide and does any act towards the commission of such offence, shall be punished with simple imprisonment for a term which may extend to one year (or with fine, or with both)\u201d.<\/p>\n<p>\u2022 <strong>In 2008, the Law Commission in its 210th Report,<\/strong> said that an attempt to suicide needed medical and psychiatric care, and not punishment.
