{"id":7127,"date":"2020-03-14T16:28:58","date_gmt":"2020-03-14T10:58:58","guid":{"rendered":"https:\/\/triumphias.com\/blog\/?p=7127"},"modified":"2020-03-14T16:28:58","modified_gmt":"2020-03-14T10:58:58","slug":"epidemic-disease-act","status":"publish","type":"post","link":"https:\/\/triumphias.com\/blog\/epidemic-disease-act\/","title":{"rendered":"Epidemic Disease Act"},"content":{"rendered":"<p><span style=\"color: #0000ff;\"><strong>Relevance: prelims\/ Mains: Polity<\/strong><\/span><\/p>\n<p><a href=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemic.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-7129\" src=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemic.jpg\" alt=\"\" width=\"435\" height=\"290\" srcset=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemic.jpg 435w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemic-150x100.jpg 150w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemic-300x200.jpg 300w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemic-120x80.jpg 120w\" sizes=\"auto, (max-width: 435px) 100vw, 435px\" \/><\/a><\/p>\n<p><span style=\"text-decoration: underline; color: #ff0000;\"><em><strong>Why in news?<\/strong><\/em><\/span><\/p>\n<ul>\n<li>A High level Group of Ministers has decided that all States\/UTs should be advised by Health Ministry to invoke provisions of Section 2 of Epidemic Disease Act, 1897 so that all advisories being issued from time to time by the Ministry of Health &amp; Family Welfare\/State\/UTs are enforceable.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline; color: #ff0000;\"><em><strong>Key highlights:<\/strong><\/em><\/span><\/p>\n<ul>\n<li>The Epidemic Act is meant \u201cto provide for the better prevention of the spread of dangerous epidemic diseases\u201d.<\/li>\n<li>Section 2 of the act empower the state government to take special measures and prescribe regulations as to dangerous epidemic disease.<\/li>\n<li>Section 2A of the Act empowers the central government to take steps to prevent the spread of an epidemic.<\/li>\n<li>According to section 3 of the act, Any person disobeying any regulation or order made under this Act shall be deemed to have committed an offence punishable under section 188 of the Indian Penal Code.<\/li>\n<\/ul>\n<p><strong><span style=\"text-decoration: underline; color: #ff0000;\"><em>Background:<\/em><\/span>\u00a0<\/strong><\/p>\n<p><a href=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemn.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-7130\" src=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemn.jpg\" alt=\"\" width=\"728\" height=\"546\" srcset=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemn.jpg 728w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemn-150x113.jpg 150w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/03\/epidemn-300x225.jpg 300w\" sizes=\"auto, (max-width: 728px) 100vw, 728px\" \/><\/a><\/p>\n<ul>\n<li>The Epidemic Diseases Act is routinely enforced across the country for dealing with outbreaks of diseases such as swine flu, dengue, and cholera.<\/li>\n<li>The colonial government introduced the Act to tackle the epidemic of bubonic plague that had spread in the erstwhile Bombay Presidency in the 1890s.<\/li>\n<li>Using powers conferred by the Act, colonies authorities would search suspected plague cases in homes and among passengers, with forcible segregations, evacuations, and demolitions of infected places.<\/li>\n<li>Historians have criticised the Act for its potential for abuse.<\/li>\n<li>In 1897, the year the law was enforced, Lokmanya Tilak was punished with 18 months\u2019 rigorous imprisonment after his newspapers Kesari and Mahratta admonished imperial authorities for their handling of the plague epidemic.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline; color: #ff0000;\"><em><strong>Provisions of the 1897 Epidemic Diseases Act<\/strong><\/em><\/span><\/p>\n<ul>\n<li>The Act is one of the shortest Acts in India, comprising just four sections. It aims to provide for the better prevention of the spread of Dangerous Epidemic Diseases.<\/li>\n<li>The then Governor-General of colonial India had conferred special powers upon the local authorities to implement the measures necessary for the control of epidemics.<\/li>\n<li>Although, the act does define or give a description of a \u201cdangerous epidemic disease\u201d.<\/li>\n<\/ul>\n<p>Its various sections can be summarized as under:<\/p>\n<ul>\n<li>The first section describes all the title and extent, the second part explains all the special powers given to the state government and centre to take special measures and regulations to contain the spread of disease.<\/li>\n<li>The second section has a special subsection 2A\u00a0empowers the central government to take steps to prevent the spread of an epidemic, especially allowing the government to inspect any ship arriving or leaving any post and the power to detain any person intending to sail or arriving in the country.<\/li>\n<li>The third section describes the penalties for violating the regulations in accordance with Section 188 of the IPC. Section 3 states, \u201cSix months\u2019 imprisonment or 1,000 rupees fine or both could be charged out to the person who disobeys this Act.\u201d<\/li>\n<li>The fourth and the last section deals with legal protection to implementing officers acting under the Act.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline; color: #ff0000;\"><em><strong>Examples of implementation<\/strong><\/em><\/span><\/p>\n<p>The act has been invoked several times since independence.
