{"id":7096,"date":"2020-03-13T14:33:15","date_gmt":"2020-03-13T09:03:15","guid":{"rendered":"https:\/\/triumphias.com\/blog\/?p=7096"},"modified":"2020-03-13T14:33:15","modified_gmt":"2020-03-13T09:03:15","slug":"foreign-contribution-regulation-act","status":"publish","type":"post","link":"https:\/\/triumphias.com\/blog\/foreign-contribution-regulation-act\/","title":{"rendered":"Foreign Contribution Regulation Act"},"content":{"rendered":"<p><span style=\"color: #0000ff;\"><strong>Relevance: Prelims: Polity<\/strong><\/span><\/p>\n<p><strong>Why in news?<\/strong><\/p>\n<ul>\n<li>The Supreme Court held that the Central government cannot brand an organisation \u2018political\u2019 and deprive it of its right to receive foreign funds for using \u201clegitimate forms of dissent\u201d like bandh, hartal, road roko or jail \u2018bharo\u2019 to aid a public cause.<\/li>\n<\/ul>\n<p><strong>About:<\/strong><\/p>\n<ul>\n<li>The verdict came on a petition challenging certain provisions of the Foreign Contribution Regulation Act (FCRA), 2010 and the Foreign Contribution (Regulation) Rules of 2011, both of which confer the Centre with \u201cunguided and uncanalised power\u201d to brand organisations \u2018political\u2019 and shut down their access to foreign funds.<\/li>\n<li>The provisions under challenge before the court included Section 5 (1) of the FCRA.<\/li>\n<li>This provision allowed the Centre a free hand to decide whether a seemingly non-political organisation was actually political in nature.
