color: #ff0000;\"><em><strong>Context:<\/strong><\/em><\/span><\/p>\n<ul>\n<li>The Supreme Court (SC) has declined to stay the operation of the Electoral Bonds Scheme (EBS), citing the fact that the plea for stay had been heard and refused in 2019 itself.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Elec.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-5840\" src=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Elec.jpg\" alt=\"\" width=\"400\" height=\"252\" srcset=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Elec.jpg 400w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Elec-150x95.jpg 150w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Elec-300x189.jpg 300w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p><span style=\"text-decoration: underline;\"><em><span style=\"color: #ff0000;\"><strong>The 2019 SC order:<\/strong><\/span><\/em><\/span><\/p>\n<ul>\n<li>In an order in April 2019, a Bench of the SC headed by the then Chief Justice of India, had asked political parties to disclose the details of the donations they had received through the anonymous bonds.<br \/>\n\u2022 It asked the parties to disclose these details in sealed cover to the Election Commission of India (ECI).<br \/>\n\u2022 Given the limited time available then and the weighty issues involved in the matter, it declined to grant a stay.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electoral-bond-scheme-1.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-5839\" src=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electoral-bond-scheme-1.png\" alt=\"\" width=\"600\" height=\"383\" srcset=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electoral-bond-scheme-1.png 600w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electoral-bond-scheme-1-150x96.png 150w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electoral-bond-scheme-1-300x192.png 300w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electoral-bond-scheme-1-360x230.png 360w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p><span style=\"text-decoration: underline; color: #ff0000;\"><em><strong>What is so disappointing?<\/strong><\/em><\/span><\/p>\n<ul>\n<li>However, it is disappointing to note that nine months on, the SC remains unmoved by submissions that a fresh window for purchase of bonds is set to be opened soon.<br \/>\n\u2022 The scheme itself was being frequently opened so that the ruling party would stand to benefit.<br \/>\n\u2022 The Reserve Bank of India and the ECI had voiced their reservations about the scheme, which was enabled by provisions of the Finance Act, 2017.<br \/>\n\u2022 The Association for Democratic Reforms, the petitioner, has disclosed that an overwhelming majority of the donations made through electoral bonds had gone to the current ruling party at the Centre.<br \/>\n\u2022 Further, the ECI has already made clear its strong opposition to the various amendments to the law on contributions to political parties.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/electoralbonds.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-5838\" src=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/electoralbonds.jpg\" alt=\"\" width=\"435\" height=\"261\" srcset=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/electoralbonds.jpg 435w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/electoralbonds-150x90.jpg 150w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/electoralbonds-300x180.jpg 300w\" sizes=\"auto, (max-width: 435px) 100vw, 435px\" \/><\/a><\/p>\n<p><em><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><strong>The ECI\u2019s response:<\/strong><\/span><\/span><\/em><\/p>\n<ul>\n<li>The ECI, in its response filed in the court, said the provisions would enable the creation of shell companies for the sole purpose of making political donations and no other business.<br \/>\n\u2022 It also said that the abolition of the clause that says firms must declare political contributions in their profit-loss accounts would compromise transparency.<br \/>\n\u2022 It added that the amendments to the law on foreign contributions would mean that there would be unchecked foreign funding of political parties, leading to foreign influence on India\u2019s policy-making.<br \/>\n\u2022 Overall, it had recorded its unequivocal position that the EBS would help the use of black money for political funding.<br \/>\n\u2022 In this backdrop, it is quite intriguing that the SC has given the ECI a fortnight to reply to the petition for stay when its position is quite clear.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electr.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-5841\" src=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electr-1024x577.jpg\" alt=\"\" width=\"810\" height=\"456\" srcset=\"https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electr-1024x577.jpg 1024w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electr-150x85.jpg 150w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electr-300x169.jpg 300w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electr-768x433.jpg 768w, https:\/\/triumphias.com\/blog\/wp-content\/uploads\/2020\/01\/Electr.jpg 1200w\" sizes=\"auto, (max-width: 810px) 100vw, 810px\" \/><\/a><\/p>\n<p><span style=\"text-decoration: underline;
