{"id":5156,"date":"2019-12-14T18:10:58","date_gmt":"2019-12-14T12:40:58","guid":{"rendered":"https:\/\/triumphias.com\/blog\/?p=5156"},"modified":"2019-12-14T18:10:58","modified_gmt":"2019-12-14T12:40:58","slug":"essential-elements-of-legislative-impact-assessment","status":"publish","type":"post","link":"https:\/\/triumphias.com\/blog\/essential-elements-of-legislative-impact-assessment\/","title":{"rendered":"Essential elements of Legislative Impact Assessment"},"content":{"rendered":"<p><strong>Relevance: Mains: G.S paper II: Polity <\/strong><\/p>\n<p><strong>Context<\/strong><\/p>\n<ul>\n<li>Recently, the Chairman of Rajya Sabha advocated the idea of Legislative Impact Assessment and called for informed lawmaking process in the country by bringing out social, economic, environmental, and institutional impacts of legislative proposals which will help in realizing the<br \/>\nstated objectives of various laws.<br \/>\n\u2022 He also stressed on the need of Parliamentary reforms in the form of 15 point charter.<\/li>\n<\/ul>\n<p><strong>About Legislative Impact Assessment<\/strong><\/p>\n<ul>\n<li>The study of the impact of a law (being made and enforced) on the society over a period of time is known as Legislative Impact Assessment (LIA).<br \/>\n\u2022 LIA is a method of estimating the likely impacts of legislative proposals and government policies, before and after they are adopted and enacted, and comparing them with different policy designs to<br \/>\ndetermine which policy produces the best result.<\/li>\n<\/ul>\n<p><strong>What are the essential elements of LIA?<\/strong><\/p>\n<ul>\n<li>Identification of the policy problem.<br \/>\n\u2022 Identification of potential legislative\/policy options.<br \/>\n\u2022 Comparative analysis of potential legislative\/policy options with each other.<br \/>\n\u2022 Stakeholder consultation.<br \/>\n\u2022 Selection of the preferred legislative\/policy option.<br \/>\n\u2022 Impact analysis of the preferred option.<br \/>\n\u2022 Identification of impact mitigation measures required (if any)<br \/>\n\u2022 Cost-benefit analysis of the preferred option.<br \/>\n\u2022 Reporting<\/li>\n<\/ul>\n<p><strong>What is the requirement for LIA?<\/strong><\/p>\n<ul>\n<li>Quick decision-making raises the questions regarding implementation of the law, associated costs and most importantly, the negative impacts that the laws may have like Biological Diversity Act, 2002, which aims to protect India\u2019s biological resources.<br \/>\n\u2022 The inherent contradictions between some of its provisions have caused significant barriers to conservation, use and development of biodiversity, thus undermining the fundamental purpose of<br \/>\nthe Act.<br \/>\n\u2022 It is essential that laws are analysed in detail before their enactment, as the country cannot afford to make expensive or irreversible mistakes with already limited resources.<\/li>\n<\/ul>\n<p><strong>What is Delegated legislation?<\/strong><\/p>\n<ul>\n<li>Delegated legislation is referred to as secondary legislation.<br \/>\n\u2022 It is made by a person or body other than Parliament.<br \/>\n\u2022 Parliament, through an Act, can permit another person or body to make such legislation.<br \/>\n\u2022 Parliament creates the broader framework of a particular law and gives the authority for legislation to other persons or bodies to provide more details to the passed Act.<\/li>\n<\/ul>\n<p><strong>Challenges ahead<\/strong><\/p>\n<ul>\n<li>Currently, no such institutionalized study is conducted to analyse the impact of the legislations being made on the society.<br \/>\n\u2022 Sometimes, the hasty passage of laws by the bureaucracy creates various hurdles in the effective implementation of that law.<br \/>\n\u2022 In India, the intent of the legislature is great but the implementation of the law suffers<br \/>\nfrom certain drawbacks.
