What appears on the surface as a technical legal matter is, in sociological terms, a profound question about <strong>power, democracy, and the structure of the Indian state.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">At stake is not just a rule\u2014it is the <strong>very nature of political representation<\/strong>, the relationship between citizens and the state, and the invisible networks of influence that shape policy, governance, and democratic legitimacy.<\/span><\/p>\n<h2 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"Political_Funding_as_a_Sociological_Institution\"><\/span><span style=\"font-family: georgia, palatino, serif;\"><strong>Political Funding as a Sociological Institution<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">Political funding is not merely about money; it is an institution that allocates <strong>power, influence, and symbolic capital<\/strong>, to use Pierre Bourdieu\u2019s term. This power circuit becomes especially dangerous when invisible.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">Anonymous cash donations below \u20b92,000\u2014enabled under Section 13A(d) of the Income Tax Act\u2014thus constitute a <strong>shadow arena of influence<\/strong>, shielded from public scrutiny.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">The petition before the Supreme Court argues that such opacity violates voters\u2019 <strong>fundamental right to information<\/strong> under Article 19(1)(a), an argument consistent with the Court\u2019s reasoning in <em>ADR v. communication,<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">it allows money to substitute public reason.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">When citizens cannot know who funds parties, deliberation becomes unequal\u2014and thus irrational in the Habermasian sense.<\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li><span style=\"font-family: georgia, palatino, serif;\"><strong> Marxist Political Economy: Capital Controls the State<\/strong><\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">From a Marxist perspective, anonymous donations create an invisible chain between capital and the political class.<\/span><br \/>\n<span style=\"font-family: georgia, palatino, serif;\">Corporate money subtly\u2014or overtly\u2014shapes:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: georgia, palatino, serif;\">industrial policy,<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">regulation,<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">taxation,<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">public procurement,<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">land acquisition, and<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">environmental clearances.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">Thus, the state becomes what Marx called the <strong>\u201cexecutive committee of the bourgeoisie.\u201d<\/strong><\/span><br \/>\n<span style=\"font-family: georgia, palatino, serif;\">Political funding becomes the mechanism through which private capital captures state institutions.<\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li><span style=\"font-family: georgia, palatino, serif;\"><strong> Mills\u2019 Power Elite Theory<\/strong><\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">Wright Mills\u2019 concept of the <strong>power elite<\/strong>\u2014where corporate, political, and bureaucratic elites merge\u2014fits India\u2019s funding structure perfectly.<\/span><br \/>\n<span style=\"font-family: georgia, palatino, serif;\">Opaque donations allow elite networks to consolidate power behind a veneer of electoral legitimacy.<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\"><strong> Public Choice Theory: Quid Pro Quo as Rational Behaviour<\/strong><\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">Public choice theorists like Buchanan argue that in the absence of regulation, politicians behave like rational economic actors\u2014seeking funds to win elections, and donors seek returns through policy concessions.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">Anonymous donations make quid pro quo:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: georgia, palatino, serif;\">easier,<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">cheaper,<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\">less detectable.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">Opaque funding thus institutionalises corruption.<\/span><\/p>\n<h2 start=\"3\">\n<li><span style=\"font-family: georgia, palatino, serif;\"><strong> Safeguarding Sovereignty<\/strong><\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">Foreign or hostile influences can silently shape domestic politics\u2014aligning with Ulrich Beck\u2019s \u201drisk society,\u201d where modern threats are invisible, transnational, and systemic.<\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"4\">\n<li><span style=\"font-family: georgia, palatino, serif;\"><strong> Preventing Market
