In India, this relationship between <strong>State, love, and the law<\/strong> is especially intricate due to its <strong>plural legal system, cultural diversity, and socio-political debates<\/strong>. From <strong>inter-caste marriages under the Hindu Marriage Act<\/strong> to <strong>interfaith unions regulated by the Special Marriage Act<\/strong>, the state has played a defining role in deciding who can marry, how they can marry, and under what conditions their love is legally recognised.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: georgia, palatino, serif;\">This topic has gained renewed attention due to recent debates on the <strong>Uniform Civil Code (UCC)<\/strong>, rising cases under <strong>\u201clove jihad\u201d laws<\/strong>, and the Supreme Court\u2019s interpretation of the <strong>right to choose one\u2019s partner<\/strong> as a fundamental right.<\/span><\/p>\n<h2 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"State_Regulation_of_Love\"><\/span><span style=\"font-family: georgia, palatino, serif;\"><strong>State Regulation of Love: <\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: georgia, palatino, serif;\"><strong>In pre-modern societies<\/strong>, marriage and love were governed primarily by <strong>customary laws<\/strong> dictated by religion, caste, and kinship systems. Additionally, <strong>\u201clove jihad\u201d laws<\/strong> in states like <strong>Uttar Pradesh<\/strong> and <strong>Madhya Pradesh<\/strong> restrict <strong>religious conversion for marriage<\/strong>, sparking debates about <strong>state overreach<\/strong> into <strong>personal choice<\/strong>.<\/span><\/li>\n<li><span style=\"font-family: georgia, palatino, serif;\"><strong>Same-Sex Relationships and Marriage Equality<\/strong>: The <strong>Supreme Court\u2019s<\/strong> <strong>Navtej Singh Johar v. Union of India (2018)<\/strong> judgment <strong>decriminalised homosexuality<\/strong>, affirming the <strong>right to love freely<\/strong>.
