because prospective candidates shortlisted for judgeships in the High Courts give up as months tick by without a decision from the government on their appointment.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">Many a bright legal mind, willing to sacrifice their law practice to join the Bench, have fallen victim to segregation of names by the government, who seemingly prefer one name to the other for unknown reasons, a Bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia noted.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><b>Refresh to basics<\/b><\/span><\/h3>\n<h4 style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><b>Collegium system<\/b><\/span><\/h4>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">It is the system of appointment and transfer of judges that has evolved through judgments of the SC, and not by an Act of Parliament or by a provision of the Constitution.<\/span><\/p>\n<h4 style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><b>Evolution of the System:<\/b><\/span><\/h4>\n<h5 style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><b>First Judges Case (1981):<\/b><\/span><\/h5>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">It declared that the \u201cprimacy\u201d of the CJI\u2019s (Chief Justice of India) recommendation on judicial appointments and transfers can be refused for \u201ccogent reasons.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">The ruling gave the Executive primacy over the Judiciary in judicial appointments for the next 12 years.<\/span><\/li>\n<\/ul>\n<h5 style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><b>Second Judges Case (1993):<\/b><\/span><\/h5>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">SC introduced the Collegium system, holding that \u201cconsultation\u201d really meant \u201cconcurrence\u201d.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">It added that it was not the CJI\u2019s individual opinion, but an institutional opinion formed in consultation with the two senior-most judges in the SC.<\/span><\/li>\n<\/ul>\n<h5 style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><b>Third Judges Case (1998):<\/b><\/span><\/h5>\n<ul style=\"text-align: justify;\">\n<li 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">A High Court collegium is led by the incumbent Chief Justice and two other senior most judges of that court.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">Judges of the higher judiciary are appointed strictly by seniority ever since the supersession controversy of the 1970s.<\/span><\/li>\n<\/ul>\n<h4 style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><b>For SC Judges:<\/b><\/span><\/h4>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">For other judges of the SC, the proposal is initiated by the CJI.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: 'book antiqua', palatino, serif;\">The CJI consults the rest of the Collegium members, as well as the senior-most judge of the court hailing from the High Court to which the recommended person
