GOVERNANCE<\/strong><\/span><\/p>\n<p><strong>Context:<\/strong><\/p>\n<p>The\u00a0<strong>amendments to the\u00a0Foreign Contribution Regulation Act (FCRA)\u00a0enacted in 2020<\/strong>\u00a0that among others\u00a0<strong>made it compulsory for NGOs to open a bank account in Delhi<\/strong> has crippled the work of many organizations that are unable to receive foreign funds.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.forbesindia.com\/media\/images\/2020\/Oct\/img_143689_fcra_1.jpg\" alt=\"FCRA: How An Emergency-era Law Will Alter The Face Of Social Work In India | Forbes India\" \/><\/p>\n<p><strong>Details:<\/strong><\/p>\n<ul>\n<li>An NGO has now moved the Delhi High Court seeking exemption from the Union Home Ministry\u2019s March 31 deadline to open an FCRA account with the SBI branch in New Delhi.<\/li>\n<li>The petitioner argued that it applied to open the account before the March 31 deadline but the\u00a0<strong>administrative delays on the part of the bank and the Ministry severely restricted its activities<\/strong>\u00a0including providing COVID-19 relief and paying of urgent salaries of staff and also affected its charitable and educational activities.<\/li>\n<li>Many NGOs are affected by\u00a0<strong>the new regulations as they are hampering charitable work<\/strong>\u00a0during the pandemic.<\/li>\n<\/ul>\n<p><strong>Foreign Contribution (Regulation) Amendment, 2020:<\/strong><\/p>\n<p><img decoding=\"async\" src=\"https:\/\/media-exp1.licdn.com\/dms\/image\/sync\/C4D27AQF6i7f3qq4Zgg\/articleshare-shrink_800\/0\/1613623036085?e=2159024400&amp;v=beta&amp;t=t95RlnG3oDzF9_ZQqyKRpJujV7CEGYAfdZkivJxFc9E\" alt=\"danamojo.org | LinkedIn\" \/><\/p>\n<ul>\n<li>Foreign Contribution (Regulation) Amendment Bill, 2020 was passed in the Parliament in September 2020.<\/li>\n<li>The Home Ministry had directed all NGOs seeking foreign donations to\u00a0<strong>open a designated FCRA account at the State Bank of India\u2019s New Delhi branch by March 31, 2021<\/strong>.<\/li>\n<li>The NGOs registered under FCRA shall not receive any foreign donations in any other bank account from April 1, 2021.<\/li>\n<\/ul>\n<p><strong>Note:<\/strong><\/p>\n<ul>\n<li>An FCRA registration is mandatory for NGOs to receive foreign funds.<\/li>\n<\/ul>\n<p><strong>Way Forward:<\/strong><\/p>\n<ul>\n<li>The pandemic has underscored\u00a0<strong>the importance of Vasudhaiva Kutumbakam<\/strong>\u00a0(the whole earth is one family) as a framework for India\u2019s global engagement.<\/li>\n<li>Thousands of NGOs\u00a0<strong>serve extremely disadvantaged sections<\/strong>, at times filling in for the state, at others, supplementing it.<\/li>\n<li>Further\u00a0<strong>relaxations are necessary in terms of opening an FCRA account with the SBI branch in New Delhi.<\/strong><\/li>\n<li>For a global community to function, there is a\u00a0<strong>need for a seamless sharing of ideas and resources across national boundaries.<\/strong><\/li>\n<li>It\u00a0<strong>should not be discouraged unless there is reason
